These Terms of Service (“Terms”) govern your use of the Elle Graci website, SMS messaging service, voice service, and related features operated by Graefika LLC (“Graefika,” “we,” “us,” or “our”).
By using Elle Graci, you agree to these Terms.
1. About Elle Graci
Elle Graci is an AI-powered messaging and voice companion operated by Graefika LLC.
The service is designed to provide conversational interaction, encouragement, entertainment, subscriber communications, and related informational content.
Elle Graci is an artificial intelligence system. You are not communicating with a human person when interacting with the AI service.
2. Age Requirement
Elle Graci messaging and voice services are intended only for adults age 18 and older.
By using the service, you represent that you are at least 18 years old.
We may restrict or terminate access if we reasonably believe a user is under 18.
3. Artificial Intelligence Disclosure
By using Elle Graci, you understand that:
- Elle Graci is an artificial intelligence system and not a real person
- Responses may be generated automatically
- AI-generated information may be incomplete, inaccurate, or inappropriate for a particular situation
- AI systems may misunderstand statements, context, tone, or intent
- You should use your own judgment when evaluating information provided by the service
Elle Graci should not be treated as a substitute for a qualified professional or emergency service.
4. SMS Messaging Program
The Elle Graci SMS Program allows users who voluntarily opt in to receive recurring text messages from Elle Graci.
Messages may include:
- Daily encouragement messages
- Subscriber updates
- Service-related information
- Occasional promotional offers
Users may opt in through the Elle Graci SMS signup process by providing the requested information and affirmatively selecting the SMS consent checkbox.
Message frequency: up to 1 message per day.
Message and data rates may apply.
Consent to receive SMS marketing or promotional messages is not a condition of purchase.
Opting Out
You may unsubscribe from SMS messages at any time by replying STOP.
After you submit a valid opt-out request, we may send a confirmation message acknowledging your request.

Carriers are not liable for any delayed or undelivered messages.
Message delivery is subject to wireless carrier networks and other systems outside Graefika LLC’s control.
Our collection and use of information associated with SMS messaging is described in our Privacy Policy.
5. Voice and Conversational Services
Elle Graci may provide AI-generated conversational experiences through telephone, voice, SMS, or other supported communication methods.
Availability, features, call duration, usage limits, and other service restrictions may vary depending on the service or subscription offered.
Calls or messages may be interrupted or unavailable because of network conditions, telecommunications providers, third-party services, technical problems, maintenance, or other circumstances.
We do not guarantee uninterrupted availability.
6. No Professional Advice
Elle Graci does not provide professional advice.
The service is not a substitute for qualified:
- Medical or healthcare advice
- Mental health or psychological care
- Legal advice
- Financial or investment advice
- Emergency services
Do not rely on an Elle Graci conversation as the sole basis for a medical, legal, financial, safety-related, or other high-stakes decision.
If you are experiencing an emergency or believe that you or another person is in immediate danger, contact the appropriate emergency services.
7. Acceptable Use
You agree not to use Elle Graci to:
- Violate any applicable law or regulation
- Threaten, harass, exploit, abuse, or harm another person
- Facilitate illegal activity
- Attempt to obtain prohibited or unauthorized information
- Interfere with or disrupt the operation or security of the service
- Attempt to bypass safety systems, access restrictions, usage limits, or security controls
- Reverse engineer, exploit, attack, or gain unauthorized access to our systems
- Use automated methods to abuse, overload, or improperly access the service
- Impersonate another person or misrepresent your authority to act on behalf of another person
We may restrict, suspend, or terminate access when reasonably necessary to protect users, our systems, our service providers, or Graefika LLC.
8. User Responsibility
You are responsible for how you use information obtained through Elle Graci.
AI-generated conversations may contain errors. You should independently verify information when accuracy matters.
You are also responsible for maintaining control of devices, telephone numbers, accounts, passwords, or other credentials used to access the service.
9. Paid Services and Subscriptions
Some Elle Graci features may require payment or a subscription.
When paid services are offered, applicable pricing, billing frequency, usage allowances, renewal terms, and cancellation information will be disclosed during the purchase or signup process.
Payments may be processed by third-party payment providers.
SMS consent is separate from the purchase of paid services. You are not required to consent to promotional SMS messages as a condition of purchasing an Elle Graci service.
10. Third-Party Services
Elle Graci relies on third-party service providers for portions of its operation, which may include telecommunications, messaging, artificial intelligence, voice technology, hosting, payment processing, and related infrastructure.
We are not responsible for outages, failures, delays, or other problems caused by systems outside our reasonable control.
Use of third-party services may also be subject to the applicable provider’s terms and policies.
11. Privacy
Your use of Elle Graci is also subject to our Privacy Policy, which explains how we collect, use, retain, and protect information.
The Privacy Policy also explains our treatment of mobile phone numbers, SMS consent information, and messaging opt-in data.
12. Service Availability and Changes
We may modify, update, suspend, discontinue, or replace features of Elle Graci as the service develops.
We may also establish reasonable usage limits or access restrictions.
We do not guarantee that every feature will always remain available or operate without interruption.
13. Disclaimer of Warranties
To the extent permitted by applicable law, Elle Graci is provided on an “as is” and “as available” basis.
Graefika LLC does not guarantee that the service will:
- Always be available
- Operate without errors or interruptions
- Produce accurate or complete responses
- Meet every user’s expectations
- Deliver every SMS message or voice communication successfully
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of Liability
To the extent permitted by applicable law, Graefika LLC will not be liable for indirect, incidental, special, consequential, or similar damages resulting from your use of or inability to use Elle Graci.
This includes losses resulting from:
- Reliance on AI-generated information
- Service interruptions
- Delayed or undelivered communications
- Telecommunications or third-party service failures
- Loss of data or access
- Unauthorized use resulting from circumstances outside our reasonable control
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
15. Suspension and Termination
We may suspend or terminate access to Elle Graci if:
- You violate these Terms
- Your use creates a security or safety risk
- Your use may violate applicable law
- Payment for a paid service is not completed when required
- Continued access could harm users, Graefika LLC, our service providers, or third parties
You may stop using the service at any time.
Termination of the service does not prevent us from retaining information that we are legally or operationally required to retain.
16. Changes to These Terms
We may update these Terms as the Elle Graci service, technology, business practices, or applicable requirements change.
When material changes are made, we will update the “Last Updated” date at the top of this page and provide additional notice when required by applicable law.
